In 2022, a federal Tennessee judge issued a gag order silencing attorney Daniel Horwitz from speaking publicly about a wrongful death lawsuit against a private correctional facility. Although gag orders often violate the First Amendment, the federal court’s local rules allowed judges in Tennessee to stop attorneys from speaking about their cases.
SLF and IJ filed a lawsuit on behalf of Horwitz, challenging the gag order and local rule as a violation of freedom of speech. In a win for lawyers across the state, the federal court recently amended its rules to eliminate the censorship.
