Southeastern Legal Foundation supports parents’ SCOTUS petition against school district’s secret gender transition of children

[August 22, 2025] Southeastern Legal Foundation (SLF) joined a coalition amicus brief supporting the United States Supreme Court petition of Lee v. Poudre, a case brought by parents against a school district that secretly and unlawfully transitioned their daughters’ gender without their knowledge or permission.

Parents of two middle schoolers sued their school district after their children attended a Gender and Sexualities Alliance Club meeting, where they were led to question their gender. One daughter “came out” as transgender after being told that if she was not comfortable in her body, she was “likely transgender.” The other daughter became suicidal after the meeting discussions. The school encouraged students not to tell parents about the meeting discussions, and maintains other secrecy policies forbidding employees from telling parents about their children’s gender transitions.

 SLF argues in their amicus brief that the school district’s actions are an absolute affront to parental rights and the Constitution. The Supreme Court made it clear in its recent Mahmoud v. Taylor decision that parents have the fundamental right to raise their children consistent with their beliefs.

 SLF argues, “Parental authority has long been recognized as the first form of government because it is ‘the most Sacred and Ancient Kind of Authority.’” Given that parental rights have been recognized since even before the Constitution was established, schools should not be in the business of taking drastic measures like transitioning a child’s gender without express parental consent.
