SCOTUS: High Court Deals Blow to Obama's DAPA program

June 24, 2016

WASHINGTON, DC:  The U.S. Supreme Court today dealt another legal blow to  President Obama’s unlawful amnesty push. Last February, Texas federal judge Andrew Hanen issued an injunction blocking implementation of President Obama’s DAPA program under which he granted unilateral amnesty to more than 4 million illegal immigrants residing in the U.S., in addition to the more than 2 million illegal immigrants potentially excused under DACA. In November, the Fifth Circuit upheld the ruling.  The federal government appealed, hoping the Supreme Court would find that the states lacked proper standing to challenge the grant of amnesty. The Supreme Court today upheld the Fifth Circuit’s decision and sent the case back to the district court for a full hearing on the merits. On behalf of a group of constitutional scholars, SLF submitted an amicus brief in April on the subject of state standing, which the Court agreed was a key issue.
